  THE FINE IS UP TO $100.00 PER DAY UNAUTHORIZED TENANTS ARE IN THE UNIT.


NEW YORK STATE LAW (SECTION 339-KK) ALLOWS THE CONDOMINIUM ASSOCIATION TO COLLECT UNAUTHORIZED TENANT RENT.  THE UNAUTHORIZED TENANT IS ALSO PROTECTED BY THE SAME LAW FOR NON PAYMENT TO THE NON-OCCUPYING OWNER AS LONG AS PAYMENT IS MADE TO THE CONDOMINIUM ASSOCIATION.

Cobbleridge Homeowners passed an amendment to the By-Laws in 1999 which gave the Board of Managers the power to enact reasonable rules and regulations regarding the leasing and renting of units.  You can read the amendment to the bylaws in:

Article III.  Section 5.  subparagraph (a) subparagraph 15  and Article XI.  Section 1. -  Selling and Leasing Homes

ARTICLE XI. SELLING, MORTGAGING AND LEASING HOMES, Section 1. Selling and Leasing Homes:  d. Except that no Home Owner shall convey, mortgage, pledge, hypothecate, sell, lease or rent his Home unless and until all unpaid common charges assessed against  his Home shall have been paid to the Board of Managers.

The existing Article 17th of the Declaration was amended by adding a new subparagraph (k):

The Board of Managers adopted these rules in May 2000.
